Product-specific Terms – Choice Gift Card

Applicability

  1. These terms and conditions govern the legal relationship between Giftcards Group B.V. and the holder of a digital or physical Choice Gift Card gift card (hereafter referred to as the “CGC”) issued by Giftcards Group B.V.
  2. The CGC is a prepaid gift card linked to a stored credit value between 20 and 1000 AUD, administered within the central systems of Giftcards Group B.V.

Validity Period

  1. The CGC is valid for 3 years from the date of activation (activation occurs automatically after purchase). After this period, the remaining credit expires and cannot be redeemed.
  2. Cardholders can check the balance and expiry date at any time through our digital platforms or by contacting customer service, at no cost.
  3. Once expired, the CGC cannot be used or redeemed as a method of payment.
  4. The CGC, including any remaining balance, cannot be exchanged for cash under any circumstances, except where required under Australian Consumer Law.

Transferability

  1. The CGC may be legally traded only via Giftcards Group B.V.’s digital platforms or through authorised resellers as nominated by Giftcards Group B.V.
  2. The CGC may be transferred to another individual free of charge, for the purpose of being given as a gift.

Usage

  1. Each CGC contains a unique 19-digit card number and a security code. Cardholders are responsible for safeguarding this information. Giftcards Group B.V. does not provide refunds or replacements for lost, stolen, or misused cards.
  2. The CGC may be redeemed for listed gift cards or vouchers available via GIFT-CARD.COM/AU, up until the expiry date. It is not valid for use on other websites or at physical retail stores.
  3. The CGC must not be used for commercial purposes or in any way contrary to its intended use.

Blocking and Suspension

  1. Giftcards Group B.V. reserves the right to suspend or permanently block one or more CGCs in cases of suspected fraud or misuse.
  2. CGCs may also be suspended where there are concerns about a business customer’s creditworthiness or overdue payment.
  3. In events of force majeure, Giftcards Group B.V. may suspend the redemption of gift cards indefinitely, without liability. "Force majeure" includes, but is not limited to, natural disasters, war, acts of terrorism, pandemics, strikes, government intervention, utility failures, telecommunications disruptions, or third-party service failures.

Payment and Activation

  1. Credit is applied to the CGC only after successful payment, unless otherwise agreed in writing by both parties.

Gift Card Offering

  1. Giftcards Group B.V. may modify the selection of redeemable gift cards at any time within reasonable limits. No rights may be derived from the selections shown on packaging, promotional materials, or digital platforms.

Refunds

  1. CGCs purchased via third-party resellers or retail partners are not eligible for refunds through Giftcards Group B.V.
  2. Once a CGC has been redeemed via our digital platforms, the selection is final. These transactions do not fall under Australian distance selling provisions and are not refundable.

Other Provisions

  1. These product-specific conditions are an integral part of the general terms and conditions published on this website.
  2. If any provision of these terms is found to be invalid under Australian law, the remaining provisions will remain enforceable. The parties agree to replace any invalid clause with one that best reflects its original intention in a lawful manner.

Article 3: Definitions

  • Gift Card: A prepaid physical or digital card or voucher, issued by Giftcards Group B.V. or a third-party Issuer, containing monetary value that can be used for purchases from nominated merchants.
  • User: Any individual or organisation that purchases or redeems a Gift Card.
  • Website: The online platform operated by Giftcards Group B.V. where gift cards are offered, managed, and redeemed.
  • Issuer: A third party (not Giftcards Group B.V.) responsible for the issuance, value, and redemption conditions of certain gift cards sold via the Website.
  • Activation: The date and time when a Gift Card becomes valid for use and the credit becomes available.
  • Balance: The available remaining amount on a Gift Card.
  • Redemption: The act of using a Gift Card to pay for goods or services, either partially or in full.
  • Expiration Date: The date after which a Gift Card can no longer be redeemed.
  • External Gift Card: A Gift Card issued by an entity other than Giftcards Group B.V., but available through our Website.

Article 4: Purchase and Redemption

  1. External Gift Cards may be purchased via our website and may include additional terms set by the issuing merchant. Always consult the product’s official website for details.
  2. Once purchased, a Gift Card is non-refundable and cannot be exchanged for cash, except as required by Australian law (e.g. where cash-out of small balances is mandated).
  3. Gift Cards are redeemable only with the participating merchants identified at the time of purchase.
  4. Users are responsible for storing their Gift Cards securely. We are not liable for lost, stolen, or unauthorised use of a Gift Card.
  5. We reserve the right to delay, cancel, or refuse any Gift Card transaction suspected of being fraudulent or abusive.
  6. Physical Gift Cards are delivered via post within the estimated timeframe provided at checkout. We are not responsible for postal delays caused by third-party carriers.

Article 5: Validity and Expiration

  1. Gift Cards include an expiration date, as communicated at the time of purchase. In compliance with Australian Consumer Law, gift cards sold for use in Australia must have a minimum validity of 3 years from the date of issue, unless exempted by law.
  2. Any remaining balance after the expiry date is not redeemable, unless otherwise required by applicable Australian regulations.
  3. Some merchants may impose their own conditions on Gift Card use. We are not responsible for such additional restrictions.
  4. For External Gift Cards, balance checks are typically available via the respective issuer’s website.

Article 6: Refunds and Cancellations

  1. Unless otherwise required by law, or as outlined below, all orders placed through this website are final and non-refundable.
  2. If you are entitled to cancel your order under applicable consumer law, please contact our Customer Service team within the eligible cancellation period and inform us of your intent to cancel. We will then proceed to cancel the gift card(s).
  3. Once your order has been cancelled, any applicable refund will be processed within a reasonable timeframe.
  4. Please note that some financial institutions may hold the refunded amount for up to 30 days before releasing it to your account.
  5. Gift cards obtained by redeeming a Choice Gift Card are non-refundable, non-exchangeable, and cannot be returned. All such selections are final.
  6. Physical gift cards may be eligible for a refund within 14 days of delivery, provided they are unused, unactivated, and in their original condition. Contact our Customer Service team to initiate the return process.
  7. Refunds cannot be issued for physical gift cards that have been damaged, activated, or used in any way.
  8. Unless the return is due to an error on our part, customers are responsible for return shipping costs.
  9. Proof of purchase may be required to process any refund or cancellation.
  10. Digital gift cards cannot be refunded or cancelled once delivered or activated, unless otherwise required by Australian Consumer Law.
  11. The right of withdrawal does not apply to purchases made by businesses or other legal entities.

Article 7: Payments and Fees

  1. Payments for Gift Cards must be made using the approved payment methods listed on our website.
  2. Certain payment methods may incur transaction fees. All applicable fees will be disclosed clearly prior to confirming the purchase.
  3. If a payment is disputed or reversed, we reserve the right to suspend or cancel the corresponding Gift Card(s) until the issue is resolved.

Article 8: Liability and Limitations

  • We issue and manage our own Gift Cards and guarantee their validity in accordance with these Terms.
  • When Gift Cards are used to purchase goods or services from third-party merchants, we act solely as a distributor or facilitator. We are not responsible for the availability, quality, merchantability, or delivery of goods or services offered by third parties.
  • We are not liable if a participating merchant refuses to accept a Gift Card. In such cases, you should contact the merchant directly.
  • To the fullest extent permitted by Australian law, we are not liable for any indirect, incidental, punitive, or consequential losses or damages.
  • We are not responsible for delays or non-performance resulting from events beyond our reasonable control, including but not limited to war, strikes, pandemics, power outages, or internet failures.

Article 9: Fraud Prevention and Security

  1. We reserve the right to cancel any Gift Card suspected to have been obtained through fraudulent means.
  2. Users are responsible for keeping their payment, account, and Gift Card details secure at all times.
  3. If you suspect that your Gift Card has been used without authorisation, please notify us immediately so that we may investigate and, where possible, take remedial action.

Article 10: Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands, except to the extent that mandatory Australian consumer protection laws apply and provide additional rights to Australian consumers.

  • If you are a business customer, all disputes shall be subject to the exclusive jurisdiction of the courts in Amsterdam, the Netherlands.
  • If you are a consumer, you may bring legal proceedings in your local court as permitted by Australian consumer protection legislation.
  • Nothing in these Terms excludes or limits your statutory rights under the Australian Consumer Law, including your entitlement to remedies for faulty goods or services.

Article 11: Changes to These Terms

Giftcards Group B.V. reserves the right to amend these Terms at any time without prior notice. You should review the current version of the Terms each time you use our website to ensure you understand the conditions that apply at that time. Continued use of the website or our services following any changes indicates your acceptance of the updated Terms.

Article 12: Intellectual Property

All content on this website including but not limited to text, graphics, logos, images, trademarks, and software is the intellectual property of Giftcards Group B.V. or its licensors. You are not permitted to copy, reproduce, republish, or reuse any part of the website’s content without our prior written consent, except to the extent required to use the website in accordance with these Terms.

Article 13: Termination

We reserve the right to suspend or permanently terminate access to our website or services at any time, including in cases of misuse or breach of these Terms. Suspension or termination may occur without prior notice.

Article 14: Entire Agreement and Severability

These Terms, together with any referenced policies, represent the entire agreement between you and Giftcards Group B.V. and override any previous understandings, whether oral or written. If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remainder shall remain in full force and effect.
